Bortex Privilege Club

1. General


The Bortex Privilege Club is managed by Roosendaal Trading Ltd. and Notos Malta, hereinafter referred to as 'The Company' or 'we/us/our'. A company registered in Malta with address A11, Marsa Industrial Estate, Marsa MRS 3000, Malta.

As a member, you accrue points for eligible purchases at participating outlets, which include: Bortex Fine Tailoring, Gant, Polo Ralph Lauren, Lacoste, Bortex Clearance Outlet, Gozo Luxury Outlet, Barlowes (limitedly for purchases of products sold by Roosendaal Trading Limited) and through our e-commerce platform available at www.bortex.com.mt.

1. General


The Bortex Privilege Club is managed by Roosendaal Trading Ltd. and Notos Malta, hereinafter referred to as 'The Company' or 'we/us/our'. A company registered in Malta with address A11, Marsa Industrial Estate, Marsa MRS 3000, Malta.

As a member, you accrue points for eligible purchases at participating outlets, which include: Bortex Fine Tailoring, Gant, Polo Ralph Lauren, Lacoste, Bortex Clearance Outlet, Gozo Luxury Outlet, Barlowes (limitedly for purchases of products sold by Roosendaal Trading Limited) and through our e-commerce platform available at www.bortex.com.mt.

1.1. The Company retains the authority to revoke or terminate any or all memberships, decline point awards, retract points, or deny point redemption for any violation of these terms and conditions.

1.2. The benefits and offers provided to you under the programme are subject to change or withdrawal without prior notice. The company assumes no responsibility for any liabilities arising from such alterations.

1.3. Points are only eligible for redemption after being credited to your account, preventing their use in the same transaction where they were earned.

1.4. Acquiring additional points through this programme is not an available option.

1.5. Once points have been utilised for a reward, the redemption process is irreversible, and points cannot be reinstated. Exceptions may apply as per the Terms & Conditions of the specific reward or promotional offer.

1.6. The Company reserves the right to adjust the method of earning and redeeming points, including altering the quantity and value of accrued points.

1.7. Participation in the programme is restricted to individuals of legal age, defined as either legally emancipated or having reached the age of majority in their respective jurisdiction, possessing the capacity to enter into binding contracts.

1.8. Each member is permitted to maintain only one active Bortex Privilege Club membership. Any violation of this rule may lead to the cancellation of all Bortex Privilege Club memberships held by the individual, with accrued points on such cards becoming ineligible for redemption.

1.9. The Company holds the authority to cancel or terminate an account if 18 months elapse from the date of the last transaction.

1.10. We retain the right to conduct audits of the scheme and your account at any time, without obligation to provide prior notice. This is done to ensure compliance with the scheme rules.

1.10.1. If an audit uncovers discrepancies and/or violations, we may suspend your account pending further internal evaluation. During the suspension period, you won't be able to earn or redeem points, utilise services associated with your account, or access any other related benefits.

1.11. In the event of a scheme malfunction due to errors, glitches, defects, viruses, bugs, unauthorised tampering, and/or intervention by third parties, we will make every effort, without assuming liability, to swiftly and smoothly restore your account and accumulated points.

1.12. By consenting to receive email or SMS communications, you are granting permission to receive such communications from all brands under The Company umbrella as well as personalized google adverts.

2. Earning

2.1. Enrolling in a loyalty subscription allows you to earn points at a rate of 1 point per €20.

2.1.1 Upon achieving gold membership status, you are entitled to earn points at an enhanced rate of 2 points per €20.

2.2. To accrue points for your purchase, it is imperative to provide your mobile number or email address at the point of sale.

2.3. Points balances cannot be combined with those of any other member at any given time.

2.4. Points are strictly non-transferable to another account/member.

2.5. Points can only be earned at Participating Outlets. The Company reserves the right to include or exclude any of the Participating Outlets at its discretion.

2.6. Points are deemed valid only if earned in strict compliance with these Terms & Conditions. The Company reserves the right to deduct points from accounts believed to be acquired unduly or unlawfully, including the use of scripts, bots, or other automated means that simulate compliance with the applicable requirements.

2.7. Points have an expiration time frame of 12 months from date of earning. Any unredeemed points will be lost, after this limit. The company reserves the right to adjust this time period at its discretion.

2.8. Points cannot be earned on the following: any alterations, consumable items (such as shopping bags), products and services by Percy Nobleman, items from Capt. Caruana and purchases made at Manouche.

2.9. Points cannot be earned on purchases paid for using Bortex gift vouchers, One4all vouchers or other vouchers issued by third parties, unless otherwise decided by The Company.

2. Earning

3. Redemption

3.1. Redemption of points/coupons is not applicable to items on sale or during the Bortex Clearance Outlet Bi-annual Warehouse Sale held at the Mriehel outlet. It is also not applicable on gift vouchers and items on which points cannot be earned.

3.2. Pressing and monogramming rewards are exclusively redeemable on garments that were originally purchased from The Company.

3.3. Points hold no cash value and are, therefore, not redeemable for cash. The accumulation of points in your account does not grant any vested rights or entitlements.

3.4. All points accumulated strictly remain the property of the company.

3.5. We retain the right to alter and adjust the value assigned to rewards. Additionally, we may suspend and/or terminate any part of the scheme and its operation without liability and without prior notice to you.

3. Redemption

4.2. The company reserves the right to terminate the scheme and/or your account at its discretion. In such cases, we will provide you with a two (2) months' notice through a notification email sent to the email address you have provided us.

5. Miscellaneous

5.1. Every effort has been taken to ensure the accuracy, currency, and correctness of these Terms & Conditions in alignment with our current policies. Should any provision within these Terms & Conditions be deemed invalid, illegal, or unenforceable by a court of law, such declaration shall not impact the validity of the other provisions contained herein.

5.2. The Company commits to processing all personal data collected in connection with the Bortex Privilege Club in compliance with Regulation (EU) 2016/679 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation). For further details on the purpose and method of data processing, as well as additional information on your rights as a data subject, please refer to our Privacy Policy.

5.2.1.The Company may collect your personal data and/or share it with other suppliers and/or service providers for the general operation of the scheme, including tasks such as maintenance, marketing, and analytics.

5.3 The Company, including its directors, employees, agents, affiliates, and subcontractors, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if The Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the loyalty scheme or any benefits thereof; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the loyalty scheme; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the loyalty scheme; or (v) any other matter relating to the loyalty scheme.

5.1. Every effort has been taken to ensure the accuracy, currency, and correctness of these Terms & Conditions in alignment with our current policies. Should any provision within these Terms & Conditions be deemed invalid, illegal, or unenforceable by a court of law, such declaration shall not impact the validity of the other provisions contained herein.
